! TERMS OF SERVICE !
ᕱᕱ Commission Refusal :ᕱᕱ
• I hold the right to refuse any commission for any reason without needing to specify why.• Please check my FAQ to see what I will and won't draw.• I hold the right to refuse commissions to those who heavily use and endorse AI as I do NOT allow any of my artworks to be fed into AI apps.
ᕱᕱ Payment method and currency :ᕱᕱ• Accepted Currency :
• I only take commissions in £ (GPB)
--
• Payment method :
• I only accept Paypal or Vgen• Payments will be conducted via Paypal invoicing (I can help set this up and answer any questions).• Payment plans are regularly available where details regarding them will be specified on posts and advertisements.
ᕱᕱ Commercial Rights and My Copyright :ᕱᕱ
- I hold all rights to my intellectual property (including Illustrations and designs), therefore, these can NOT be sold for any form of monetary, buyout or commercial usage.- Those found attempting to sell my IP (Illustrations and designs) for any commercial gain on online platforms such as Amazon or in physical buildings such as Conventions like Comicon etc will be reported to the appropriate authorities as this is considered a breach of laws in my country of which I am protected by.
ᕱᕱ Refund Policy :ᕱᕱ
- Due to commissions being my primary source of income, I do NOT offer refunds when they are requested so please ensure you are certain about purchasing something from me prior.^- As I am protected by seller protection laws, commissioners are NOT entitled to refunds for reasons that I am not legally responsible for
╰┈➤ Some examples are :
➤ The commissioner deciding they don't want the artwork anymore while I'm still working on the artwork.
➤ Informing me you are happy with the product throughout every stage then changing your mind when it’s completed
➤ Commissioners changing the design of the character after I've already coloured the artwork- Commissioners who commit fraudulent acts such as chargebacks (no matter what stage of the process I have reached), will be reported and permanently blacklisted from my services.
ᕱᕱ Emergency Refund Policy :ᕱᕱ- While I do not offer refunds, I am sympathetic to the fact unfavourable events can arise, therefore, I am happy to offer an emergency solution during these situations where commissioners can submit an emergency refund request:- If an emergency arises where you need the money back, I must receive evidence regarding your situation as I can not accept a refund request if I can not prove it's a genuine emergency.
- I will keep a % of money as compensation for what I have already completed and you will then receive the rest of the money as a refund.╰┈➤ ^I can split my work process into 4 stages, therefore, every stage is worth 25%.
➤ Sketch 25% | Colour 25% | Shading + lighting 25% | Final touches (rendering and adding overlays) 25%
╰➤ E.g if you ask for a refund after I have finished the rendering and lighting, you will receive the remaining 25% of your payment as a refund. If you need a refund and I've only sketched, you will receive the remaining 75% of money back as a refund.--
^- Disclaimers:- I am unable to accept any emergency refund request (no matter how much evidence you provide me with) if you purchased something from me while I have an 'emergency sale'.- These are for genuine emergencies ONLY.
For example : You need some of the money back for a sudden life threatening event, you got hit by a car and have sudden medical surgeries that you need the money for, your pet accidentally ate something and is seriously sick and you need the money to see the vet.- It a broad topic so I will happily discuss an emergency refund request in dms, however, this is in no way shape or form a system to be abused for frivolous spending (cancelling a commission just to buy a new handbag).- Should I refuse your emergency refund request for any reason, I will still complete your commission and provide you with a detailed final product as agreed.
ᕱᕱ Commission Process :ᕱᕱ
-
• Before your commission is started:
- Please be as detailed as possible while providing me with descriptions, necessary notes, reference images etc to ensure the product turns out exactly as imagined.
- DISCLAIMER: I am unable to copy/ heavily reference from other copyrighted content due to infringement laws, I can however, reference your image.• The process during your commission:
- I require explicit consent from the commissioner to be able to move onto further stages of the artwork (e.g I cannot move onto colouring if the sketch is not approved) in which case, the commissioner immediately acknowledges that they have wavered their right to correct the previous stage without now paying comensation for everything I must correct/ change.• Edits regarding your commission:
- Should commissioners want something to be added or edited after verifying a stage, I must be paid appropriate compensation. The cost of the edits will depend on how much I have to go back and change and if our contract has already ended (if I have already completed the artwork).- I am NOT legally responsible for any mistakes that are not pointed out nor am I legally responsible for commissioners forgetting or refusing to communicate certain pieces of information to me so it is the commissioner/ buyers responsibility to be as detailed as possible and to ensure they inspect the stages/ updates carefully and precisely before consenting for me to move on.
ᕱᕱ The Handling Of My Artworks :ᕱᕱ
- Those who receive art from me with no monetary value including: gifts, raffle prizes, contest entries, dtiys entries etc, must NOT attempt to use this as a way to add extra monetary value to a character (e.g you may not use free art to add monetary value when selling a character on toyhouse).- Commissioned pieces are allowed to add value to that characters overall worth, however, the seller/ commissioner must NOT price my artworks value higher than what was paid.- My signature/ copyright must NOT be removed or covered up as credit and copyrights must not be wrongfully claimed and stripped from me in any way.
ᕱᕱ Adoptables and Customs :ᕱᕱ• Licensing:
- Buyers do NOT have any buyout/ commercial rights unless the topic is discussed prior to the purchasing of the character and the buyer is awarded some form of documentation stating they have purchased this.
Disclaimer: the purchasing of commercial rights and buyouts is not available and cannot be purchased.• IP and Copyright :
- In order to respect and comply with both copyright laws and the copyright I hold over my IP, adopts may be redesigned, however, they must not become unrecognisable. Buyers MUST create a new character if they become unrecognisable, especially if you plan to do anything with said character that may clash with any form of copyright infringement.• Branding and Commercial Usage:
- Those who have purchased an adopt are allowed to make that character the profile picture/ banner etc of their account, however, you must NOT use them as the face of a brand or in any other way where they are clashing with commercial rights laws (e.g receiving/ selling merchandise of the character).• Reselling and Pricing:
- Adopts can be resold, however, the base price must remain the same as the amount paid and must NOT be sold for a higher price than what they were purchased for (e.g if no items of extra monetary value have been added and the character is being sold on their own, you must sell them for the price you paid only).- If the adopt was purchased while on discount and no extra monetary value has been added (no extra art from others), you can NOT sell the adopt for the original price - you must only sell the character for the same amount purchased.- If you have bought an adopt from me outside of toyhouse and wish to resell them, you MUST contact me prior and inform me of who the new owner will be so that I can ensure my TOS has been agreed to and will continue to be followed.- Adopts that have no monetary value and were made/ received for free (e.g gifts, raffle prizes, contest entries, dtiys entries etc) must NOT be resold for any amount of money. These types of adopts must be given away via means that do not include or require the involvement of any currency (e.g someone can receive art for the character instead of money).• Your responsibility :
- I am not responsible for and will not offer any form of compensation if you happen to encounter a mishap during your trading/ re-selling of my character/ adopt.
- Please ensure due diligence when re-selling as I will not get involved unless the transaction has violated one of my terms.- Co-owning characters/ adopt is acceptable to do, however, I will not get involved nor offer any form of compensation should any personal issues arise between all involved parties.• Banned Usage:
- Under no circumstances can my designs be used for any fetish work (feet, feeding, diaper and any other form of fetish no matter how light or heavy they are).
- Under no circumstances can my designs be used for art that depicts illegal acts (paedophilia , zoophilia and other extremes).
- If I am alerted anyone has done this, I will publicly post your name on my social media so others know not to sell to you.------
- Anyone found to have an adopt from me that still has my “adopt stolen from LoushBon” copyright on it may be attempting to steal my design and must be reported to me immediately.
ᕱᕱ My Illustrations+ Designs- Toyhouse :ᕱᕱ• Toyhouse Profile Rules :
- My characters must NOT be hidden from me on Toyhouse no matter the reason. You are welcome to authorize me without having to ask me first.
- You must NOT cover my designs and art in your heavy watermark on Toyhouse, I take the time to appropriately watermark and protect my artworks so there is no need to heavily cover them yourself.• Reselling and Pricing:
- Those who resell on social medias such as ‘ToyHouse’, must NOT remove the link to my TOS and you MUST add the worth of all added art and the price you sold them for in the ‘character transfer’ tab (also known as the ownership history tab), as this will act as a receipt for me regarding the transaction (e.g ‘sold for £35'. Any inappropriate messages that do not contain the worth of the character could result in you being blacklisted).• Your responsibility :
- I am not responsible for and will not offer any form of compensation if you happen to encounter a mishap during your trading/ re-selling of my character/ adopt. Please do your due diligence when re-selling as I will not get involved.- Co-owning characters/ adopt is acceptable to do, however, I require credit if you both make the character a profile. Attempting to put your name as the creator on the profile you made is not allowed and I will be in contact with you to have such an error changed.
- You are welcome to dm me if you are attempting to give me credits on toyhouse so I can accept your request faster.
ᕱᕱ Social Media :ᕱᕱ
- By default, I will post all of my art to all of my social media’s, therefore, commissioners must inform me prior to me completing the artwork (or just as I’ve completed it) that they do not want their artwork posted onto specific or all of my social medias.- Commissioners must inform me before I begin the artwork if they require me to keep works in progress screenshots off specific or all social media.- Commissioners are NOT allowed to post their commissioned artworks to any social media unless I have been provided with evidence proving that the buyer has opted out of meta’s ai training. Commissioners who were unable to opt out of the ai training (or are unable to prove they did), may only post art to websites that openly state that they do not forcibly train ai via art posts (such as Bluesky and Cara) where I MUST be tagged and given full credits.- Please do not hesitate to get in contact with me if you are unsure of how to prove you opted out of meta’s ai training as I can aid you.
ᕱᕱ Communications in DM's and Emails :ᕱᕱ
- Commissioners MUST be able to provide a durable medium (e.g an email) that I can access for communications regarding your commission and so I am able to send you the files of the finished product.- Please ensure conversation in Direct messages/ durable mediums are kept appropriate and professional. I am happy to speak in a friendly manner, however, I ensure I keep a professional relationship with all clients only which also ensures my time is not taken away from my work.
- I would like those working with me to please by mindful of your words and ensure you are speaking to me as an artist and not as a bestfriend or a romantic partner.- Rush fee’s MUST be paid if commissioners require the artwork to be done before a certain date. Commissioners are not entitled to receiving their artwork before others that are above them in the trello to do list if rush fee’s are not paid. Below is the link to the trello board where you can find the place and status of your commission.- I use the website ‘Trello’ to post up to date screenshots of my progress on a piece, therefore, it is the commissioners’ responsibility to regularly check the website should they want to see real time updates. It is also the commissioners’ responsibility to communicate with me prior to me starting the artwork if this method of receiving updates is of any inconvenience.
